In the legal documents, the ‘Flashing Lights’ rapper’s legal team points out that the reputation of his brand ‘is being harmed by the association with the imitation shoe’ due to ‘its subpar quality.’
AceShowbiz –Kanye West makes it clear no one can sell an imitation of his Yeezy’s products. The “Runaway” rapper has reportedly filed a lawsuit against Walmart for allegedly selling fake version of his brand’s “Foam Runner” shoes.
In the legal documents obtained by The Blast, the 44-year-old musician stated, “Walmart is flagrantly trading off of his and Yeezy brand’s popularity by offering for sale an imitation version of the Yeezy Foam Runner.” The “Flashing Lights” spitter’s legal team also included, in the lawsuit, pictures of the two items which look very much alike.
“Walmart’s conduct is harming and will continue to harm, West and Yeezy, leaving them no choice but (to sue) to stop Walmart’s unfair competition and profiting from the popularity of the success of West and Yeezy,” the rapper’s lawsuit further read. It went on to remind Walmart that the Yeezy brand is worth “billions” of dollars, and the potential loss from the imitation shoes is in the “hundreds of millions.”
The suit further stated that celebrities, including Justin Bieber, Ariana Grande, Jay-Z, Hailey Baldwin, Gigi Hadid, Bella Hadid and Snoop Dogg, are often seen photographed in the Yeezy brand, which in turn “enhances the brand’s popularity and appeal to the general public.” It noted, “Celebrities are regularly photographed wearing Yeezy clothing and footwear and using Yeezy products, which enhances the brand’s popularity and appeal to the general public.”
“[Kanye] sets trends for everything he touches,” was added to the legal documents. “Simply put, Kanye West is a household name, and the Yeezy brand, which has become synonymous with West, has become one of the most influential and successful brands in fashion.”
Elsewhere in the suit, the legal team of Kim Kardashian‘s estranged husband pointed out the damage from selling the products. “Not only are West and Yeezy losing market share for their authentic Yeezy Foam Runner, but also their reputation and the goodwill of the Yeezy brand is being harmed by the association with the Imitation Shoe given its subpar quality,” they noted.
In response to the accusations, Walmart [released] a statement to TMZ that clarified the products at-issue are not its own and are sold by third-party vendors. “We take allegations like this seriously and are reviewing the claim,” the mega-store company said. “We will respond in court as appropriate after we have been served with the complaint.”
